JUDGM£NT M.C. Jain, C.J. : The petitioner (occupier of a factory) canvassed a grievance that the Cane Commissioner in exercise of powers of Section 15 of the U.P. Sugarcane (Regulation of Supply and Purchase) Act, 1953, assigned a particular area of cane growers to two factories, namely, the petitioner, Rai Bahadur NARAIN Singh Sugar Mills Ltd. and the respondent no. 6, Uttam Sugar Mills Ltd. 2. It is forcefully urged before us that under the scheme of• the relevant provision, such assignment at a time to two factories is not admissible. The order of Cane Commissioner is, therefore, per se wrong. 3. We heard Sri A. K. Srivastava, learned counsel for the petitioner, Sri Manoj Tiwari, representing respondent no. 6 and Sri Sudhanshu Dhula, learned C.S.C. We quite see force in the contention of the petitioner. 4. However, it is reported that the season for supply of sugarcane is over. Therefore, no useful purpose would be served by interfering with the order which is...exhausted. We, therefore, dispose of the petition as in fructuous.
