ORDER Heard learned counsel for the petitioner. None appears for the respondent despite service of notice. 2. In this petition, the petitioner has prayed for transfer of the suit, C.S. No. 5/95 titled M/s. Siddhi Stones and Granites Ltd. v. M/s. Binny Ltd. (now known as M/s. Binny Engineering Ltd.) pending in the Court of the Additional District Judge, Jaipur City, Jaipur, Rajasthan to be transferred to the Court of VII Additional City Civil Judge, Madras, Tamil Nadu and to be tried alongwith O.S. No. 2008/96 titled M/s. Binny Engineering Ltd. v. M/s. Siddhi Stones & Granites Ltd. It is stated in the petition that the dispute raised in both the suits relates to the same transaction and the parties are also the same. In the circumstances, it is appropriate that both the suits will be tried together. Accordingly the prayer for transfer of afore-mentioned suit is allowed. C.S. No. 5/95 pending in the Court of Additional District Judge, Jaipur is transferred to the Court of VII Additional City Civil Judge, Madras. The transfer petition is allowed.
