Short Note These applications arise out of the Crime No. 109/2000 of P.S. Dinara, hence taken up together. Heard Shri Rakesh Saxena, D.R. Sharma and M.P.S. Bhadoriya learned counsel for applicants and Shri Suryavanshi learned Panel Lawyer for respondent -State. Accused/applicants Imrat, Uttam, Vanmali and Narain among others (total 14 numbers) are arrested and charge sheeted for the offences under sections 147, 148, 302, 307, 323, 224, 336, 452 and 506 read with section 149, IPC. It is pointed out by the learned counsel for applicants that as per statement of the deceased (who survived for sometime) recorded under section 161 Cr.P.C. neither of the present applicants caused any injury to him, The deceased had specifically named four co-accused of the case for inflicting injuries to him, It is further pointed out that another co-accused Pathua similarly situated has already been granted bail by this Court vide order dated 17.1.2001 in M.Cr.C. No. 3111/2000. On consideration of submissions as advanced, and the nature of over-tact attributed to the applicants, their applications are allowed and it is directed that they be released on their each furnishing personal bond in sum of Rs. 30,000/- one surety in the like amount to the satisfaction of CJM.
