JUDGMENT : Arijit Pasayat, J. The written briefs be filed by the learned counsel for the parties on or before 16th September, 2002. The matter be posted for hearing on 17th September, 2002. 2. There is a writ petition which has been listed today for admission being No. 456/ 2002. This writ petition is taken on board. Mr. Yatin Oza, the learned senior counsel appearing for the petitioner in this writ petition submits that the only question which arises for consideration in this case is whether the Constitution of India contemplates the existence of a caretaker Chief Minister after an Assembly has been dissolved. He states that the petitioner does not seek to urge any questions of fact and it is only this constitutional issue which requires to be considered and adjudicated upon by this Court. Issue notice to the respondents. Ms. Hemantika Wahi accepts notice on behalf of respondent No. 2 and Mr. R.N. Poddar accepts notice on behalf of the Union of India. Reply, if any, on the constitutional issue be filed by 16th September, 2002. To.come up on 17th September, 2002 along with Special Reference No. 1/2002. 3. I.A. No. 1/2002 is allowed. 4.
