Judgment 1. On the matter being called nop one has appeared on behalf of the State of Bihar. 2. Upon perusing the order which has been challenged, i.e., dated 21 January, 2000 on C.W.J.C. No. 4117 of 1999; Mohammad Hasnain & ano. V/s. The State of Bihar & Ors. [reported in 2000(1) PLJR 901 ] the court finds that this is, in effect, the third litigation by the petitioners or others like them to pursue their remedies for seeking reliefs in the matter relating to their service and promotion. 3. For one reason or the other, the State of Bihar, Department of Police is denying the promotion to the petitioner to the post of Deputy Superintendent of Police in the light of the judgment. The State respondents in the writ petition submitted for giving excuse that perhaps the matter is complicated on the basis of a decision dated 7 March, 1999 in C.W.J.C. No. 12358 of 1993. The learned Judge recorded that this should not come in the way of the Police Department as the decision had been stayed by an interim order. In the circumstances, there was no excuse for the department of Police, State of Bihar, to take action in accordance with the judgment which has been challenged. 4. This Court does not see any reason to interfere with the order of the learned Judge on the writ petition. 5. Dismissed.
