Judgment 1. On the matter being called no one has appeared to submit on the appeal. 2. The order challenged in the appeal is dated 21 August 2002 on CWJC No. 6063 of 2002 : Bal Krishna Sahay V/s. The State of Bihar and others. 3. The petitioner received a piece of land in 1984 from a Co-operative Society at the rate of Rs. 15/- per sq. ft. Subsequently, he discovered that earlier another member had received a land at a lower rate Rs. 10/- per sq. ft. He made an issue on this, in effect, seeking a reduction of the rate on the difference between the two rates. He had this matter agitated before the Joint Registrar. The Joint Registrar kept the record and he did not render his decision until the date of his retirement. The matter was further challenged before the Registrar who rejected the claim of the petitioner. 4. This Court does not find any error in the order of the learned Judge. In fact, the petitioner has attempted to unsettle the settled issue. There will be a variation of price of land as time passes by. The petitioner raised a petty issue, in effect, harassing the Society. In case the petitioner is not satisfied with the land which he has been allotted and should he continue this frivolous litigation the Society is well within its right to cancel the allotment itself. 5. The order of the learned Judge dated 21 August 2002 is affirmed. Dismissed.
