JUDGMENT 1. - Heard the learned counsel for the petitioner, learned Public Prosecutor, and perused the case diary. 2. This application for bail under Section 439 Cr.P.C., arises out of the First Information Report No. 40/2002 registered for offence under Sections 498-A and 304-B IPC. 3. On behalf of the petitioner it is contended that in the first information report there is no allegation of demand of dowry against the petitioner. It is further contended that the deceased jumped into a well and committed suicide. The petitioner is 65 years old lady and happens to be the mother-in-law of deceased. She is behind the bars for last about four months. Charge sheet has been filed. 4. Learned P.P.has opposed the bail application pointing out the fact that blood stains were found in the house also. 5. I have considered the rival submissions. 6. Taking into consideration the entire facts and circumstances of the case, particularly the facts stated above, l consider it just and proper to grant bail to petitioner under Section 439 Cr.P.C. 7. It is, therefore, ordered that the petitioner Smt.Rookma Devi W/o Kana Ram be released on bail provided she furnishes a personal bond in the sum of Rs. 30,000/- (Rupees thirty Thousand) with two sureties of Rs. 15,000/- each to the satisfaction of the trial court with the stipulation to appear in that Court or to any Court, where she is directed to appear as and when called upon to do so during pendency of the trial against her in the case arising out of FIR No. 40/2002 registered at Police Rainwal, District Jaipur.Bail Application allowed. *******
