Judgment 1. This Letters Patent Appeal has been filed against the order dated 25 September, 2002 on C.W.J.C. No. 5834 of 2002 : Shree K. Bhagwan Gond @ Shree Bhagwan Prasad V/s. State of Bihar & Ors. 2. The learned Judge has declined to interfere on the matter on the ground that a High Court would not be involved in a controversy as was raised whether the petitioners daughter may be a Gond or a Gaur or be placed as Scheduled Caste, Scheduled Tribe or other backward class or whether between the classification of Gond or Gaur one may be a caste and the other a sub caste. 3. The petitioner also cannot rely on any declaration in a civil suit in somebody elses matter. If the petitioner desires, in so far as he or his daughter is concerned, agency for specification of communities. 4. This Court finds no error in the order of the learned Judge. 5. Dismissed.
