Order Heard. In exercise of power under 3ection 140 of the Motor Vehicles Act, 1988 in M. J. C. Case No. 18 of 1994, 3rd additional District and Sessions Judge, East Singhbhum, Jamshedpur passed interim award and directed appellant Anand Bihari Dubey to pay the compensation amount to the claimants, on behalf of M/s. A. B. Traders. It is not in dispute that offending vehicle in question belonged to M/s. A. B. Traders and Prema Devi, wife of Anand Bihari Dubey is sole proprietor thereof. 2. Anand Bihari Dubey, who claims to be working as Manager of M/s. A. B. Traders has filed the present appeal challenging the interim award not on merit but on the ground that in his personal capacity he was not liable to pay the compensation amount. 3. It goes without saying that the amount of interim award is to be paid (sic-by?) and on behalf of owner of the offending vehicle. This appeal is also barred by time. It is, accordingly, dismissed.
