Judgment 1. This letters patent appeal has been filed against an order dated 4 October 2002 on CWJC No. 10071 of 2002 : Krishna Nand Jha and another V/s. The State of Bihar and others. 2. The petitioner-appellants apparently seems to be chasing and fortifying his rights to receive the pensionary benefits of a person as also hold on to a compassionate appointment when he may not be a proginey. The court refrains comments on who exactly the petitioner-appellants may be. The issues on record make it clear that the aspect of a mistress who may not be the wife and claimants who may not be progenies of a person whose pensionary benefits are claimed as also a job on the criteria of compassionate appointment which was taken from the police department when the petitioner-appellants did not have the confidence to hold it. 3. The fact that the petition has been dismissed this should have been the end of the matter. The fact that a letters patent appeal has been filed to chase up issues when fraud and mischief is an aspect on record, the appeal is misconceived.The court will not permit these issues to be debated at the High Court in prerogative writ jurisdiction. The writ petition was rightly dismissed. 4. Thus, this appeal is also dismissed.
