JUDGMENT 1. - Mahendra Singh and Kuldeep Singh who are the father-in- law and the husband of the deceased Kusam Kanwar, who died on 21.9.2001 by consuming some poisonous substance, have moved this bail application. Father of the deceased lodged an FIR to the effect that the husband as well as father and mother used to harass the deceased and she was not served proper food and was not allowed to have bath. According to the report, they were demanding Rs. one lakh as further dowry and since the money could not be paid, the husband, his sister and parents entered into a conspiracy and murdered Kusam Kanwar. 2. After arrest, the bail application moved by the accused persons was dismissed by the learned Additional Sessions Judge, Bali and hence this application. 3. I have heard the learned counsel for the applicants, learned Public Prosecutor and the learned counsel for the complainant. 4. The accused Kuldeep Singh was arrested on 28.9.2001 and his father Mahendra Singh was arrested on 29.9.2001. Since then, they are in custody. It is submitted by the learned counsel that the FIR is a result of conspiracy and it makes a mention that four persons, including the sister-in-law first conspired and then murdered Smt. Kusam Kanwar. It is submitted that the allegations, regarding alleged conspiracy and the murder, pursuant to the conspiracy, were without basis and go to show that instead of filing a realistic FIR, the same was filed with wild allegation in a highly irresponsible manner. Learned counsel further submits that the allegations have been made to the effect that for a long time, she was regularly harassed. However, it is very strange that no FIR of the alleged harassment was filed, nor the matter was referred to the respective persons of the community. 5. I do not want of make detailed discussion in respect of the merits of the rival contentions, but, after hearing the two sides, I find it a fit case, in which the applicants should be released on bail. 6. Consequently, the bail application is allowed and it is ordered that the applicants Mahendra Singh S/o Bhoor singh and Kuldeep Singh S/o Mahendra Singh be enlarged on bail, provided each of them furnishes a personal bond in the sum of Rs. 10,000/- (Rupees ten thousand only) with two sureties of Rs.

Consequently, the bail application is allowed and it is ordered that the applicants Mahendra Singh S/o Bhoor singh and Kuldeep Singh S/o Mahendra Singh be enlarged on bail, provided each of them furnishes a personal bond in the sum of Rs. 10,000/- (Rupees ten thousand only) with two sureties of Rs. 5.000/- (Rupees five thousand only) each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so. *******
