In a public interest litigation, the High Court having quashed the impugned direction on 10th April, 2002, the State has come up in appeal. The impugned direction, in our considered opinion, tantamounts to an active administrative decision and policy decision of the State, which the Court is not entitled to direct. In that view of the matter, the impugned order is set aside and the appeal is allowed. Appeal allowed.
