Judgment Viney Mittal, J. 1. The prayer made in the present application undersection 389, Cr.P.C., is for grant of bail to appellant No.3 Rajesh alias Bhola. 2. Vide order dated 19.12.2002, notice was issued to Advocate General, Punjab, for today. Mr. Gurpartap Singh Gill, teamed A.A.G., Punjab, has informed that the Investigating Officer has not come present today. 3. I have heard Shri Gautam Dutt., learned counsel appearing for the applicant appellant, Shri Gurpartap Singh, learned A.A.G., Punjab and Shri Gurpreet Singh, learned counsel appearing for the complainant. 4. The averments made in the application, duly supported by the documents Annexures A-1, A-2, A-3 and A-4, attached with the application, show that the applicant appellant Rajesh alias Bhola is suffering from serious cardiology problem. On 11.11.2002, while hg was admitted in the Rajindra Hospithl, Patiala, for his treatment, he was referred to the Cardiology Department of P.G.I., Chandigarh. 5. Under these circumstances, without expressing any opinion on the merits of the controversy, I deem it proper to enlarge the applicant-appellant Rajesh alias Bhola on bail for a period of three months from the date he is released on bail, for his medical treatment. The applicant-appellant shall be enlarged on bail to the satisfaction of the C.J.M./Duty Magistrate, Patiala.
