Judgment 1. This Letters Patent Appeal has been filed on the order of 19 April 1995 on CWJC No. 4493 of 1994 : Smt. Archana Tiwari V/s. State of Bihar and others. 2. Heard learned counsel for the petitioner, perused the records of the writ petition as well as the Letters Patent Appeal. The petitioner had barely permitted six weeks to pass since his retirement and approached the High Court for seeking his unpaid dues along with simple and compound interest on post retirement benefits. 3. On the petition the petitioner received a relief to the extent that he may file his representation for any relief prior to retirement and if it be any relief relating to retirement dues he may put in another representation. 4. In so far as the first aspect is concerned of any salary which may not have been paid to the petitioner between October 1990 upto 28 February 1994, there does not seem to be any thing on record that the petitioner had engaged the department for the arrears of these dues. Even these dues are until the date of retirement, six weeks subsequent to which the petitioner filed a petition. 5. In so far as retirement dues are concerned, the petitioner did not even give the respondents a chance to process the papers. 6. In the circumstances and regard being had to the facts on the cause which the petitioner brought, the only relief which he could get was that he may put in his representation and more. The petitioner cannot receive any future relief than was given on the writ petition to judge the cause as when it was brought. 7. Dismissed.
