By the impugned order dated 4th October, 2001, setting aside the order of the lower court the High Court directed that the interim maintenance to the tune of Rs. 1500/- be paid to the respondent from date of filing of the application, i.e. 15.11.1997. It is evident that the order was passed by the High Court without issuing notice to the appellant-husband. We fail to understand as to how the orders passed by the lower court in favour of the appellant could be set aside in revision by the High Court without even sending much less service of notice on the appellant. We may also notice that an application filed by the appellant bringing to the notice of the High Court that the order dated 4th October, 2001 had been passed without notice to him was also dismissed. Under these circumstances, we set aside the order dated 4th October, 2001 as also the order passed on 4th March, 2002 passed on review petition and remand the CRR No.2353/2001 filed by the respondent for fresh decision by the High Court after hearing counsel for the parties. The High Court is requested to dispose of the said Criminal Petition within a period of two months. The appeals are allowed in above terms.
