JUDGMENT : 1. The affidavit filed by the Expenditure Secretary doesn't contain the minute details which have been sought for to arrive at an astronomical figure in the event the direction for enhancement of judges' strength in phased manner is implemented. We direct that a fresh affidavit be filed within four weeks from today indicating the details as to how the figure has been arrived at. 2. Keeping the direction of enhancement of judges' strength aside, several other directions have been given by this Court, one of them being the higher pay-scale accepting the recommendations made by the Shetty Commission. The additional burden on that score would be around 95 crore's and odd. We see no justification in not implementing that n part of the direction, whatever may be the resource constraints. In fact, we have entertained the interlocutory application filed on behalf of the States and the Union Government to consider some aspects, including the medical facilities to be given to these officers and that matter is pending. So far as the implementation of the higher pay-scale of the officers of subordinate judiciary is concerned, we direct that the same must be given effect to on or before 1st April, 2003 and for that purpose necessary budgetary provision can be made in the budget of the respective States as well as that of the Union. 3. This matter may be called in the 2nd week of May, 2003 for further directions.
