JUDGMENT 1. - This bail application under Section 439 Cr.PC. has been filed on behalf of petitioners Mangilal, Laxmilal and Prithvi Raj against whom investigation for the offence under Section 3/7 Essential Commodities Act, 1955 is pending at Police Station Nai in FIR No. 173/2002 wherein the allegation against the petitioners is that they were transporting 1200 liters of Kerosene oil in 6 drums which were meant for public distribution on fair price shops. 2. Having heard the learned counsel for the petitioners and learned Public Prosecutor on behalf of the State and upon a perusal of the papers placed before me and looking to all the facts and circumstances of the case, as also to the fact that the petitioners are driver, Khalasi and labour, I deem it just and proper to enlarge the petitioners on bail. 3. In the result, this bail application is allowed and it is directed that petitioners namely Mangilal, Laxmilal and Prithvi Raj shall be released on bail on their furnishing a personal bond each in the sum of Rs. 20,000/- with one surety in the like amount to the satisfaction of the concerned court for their appearance before that court on each and every date of hearing during investigation, inquiry and trial.Bail application allowed. *******
