JUDGMENT 1. By this petition, petitioner prayed that he may be granted 1st parole under Rule 9 of Rajasthan Prisoners (Release on Parole), Rules, 1958. 2. The parole of the accused petitioner - prisoner has been rejected by District Parole Advisory Committee on the ground that in case the accused petitioner - prisoner is released on parole, there will be danger to his life and also danger to the life of the complainant party, in the village on account of enmity. 3. Learned counsel for the petitioner submits that in all, 6 accused persons were convicted including the accused petitioner - prisoner and out of them 3 are on bail. Learned counsel for the petitioner has submitted the certificate of Panchayat concerned certifying that there is no danger to the life of the accused petitioner - prisoner as well as to the complainant party, in case the petitioner - prisoner is released on parole. 4. Certificate issued by Sarpanch Ramjilal of Village Panchayat Jonpa Binori, Tehsil Lalsot be taken on record. 5. Considering the facts and certificate issued by Sarpanch to this effect, we are inclined to release the accused petitioner - prisoner on 1st parole under Rule 9 of Rajasthan Prisoners (Release on Parole) Rules, 1958 for a period of 20 days. 6. It is therefore ordered that the accused petitioner - prisoner Ramdayal S/o Gopal be released on 1st Parole for a period of 20 days, which includes the journey period, provided he furnishes a personal bond in the sum of Rs. 30,000/- with one surety in the like amount to the satisfaction of the Superintendent, Central Jail, Jaipur to the effect that he will surrender before the Superintendent, Central Jail, Jaipur on completion of 20 days, the Parole period. The parole period of 20 days be counted from the date of release of the accused petitioner - prisoner. 7. The petition is accordingly allowed with the above directions.Petition allowed. *******
