ORDER : M.B. Shah, J. Heard the learned counsel for the parties. 2. In the affidavit dated 22nd October, 2002 it has been pointed out that applicant has complied with the NEERI recommendations, CPCB Guidelines, Environmental Rules and other requirements. It is also pointed out that applicant was having licence to run the brick kiln prior to 1996. In this view of the matter, this application is granted. It would be open to the applicants to restart their brick kiln only. However, this restarting of the brick kiln would be subject to the inspection by the Joint Inspection Committee constituted by this Court. I.A. is disposed of accordingly. I.A. No. 362 3. Mr. Vijay Panjwani, learned counsel appearing on behalf of the Civil Procedure Code B., seeks four weeks time for filing necessary affidavit with regard to habitation as well as on other aspect and to find out whether applicant can be permitted to continue his brick kiln at the site. In view of the above, stand over for four weeks. I.A. No. 345 4. Learned counsel for the State of U.P. submits that within a period of six weeks the State Government would prepare a plan with regard to 89 hectares of land at Agra for seeing that the development of the said land remains as a green park. For this it would prepare a comprehensive plan so that a person owning roughly five hectares of land or more can have a green park complex having 10 per cent construction for cultural activities so as to have an eco- friendly tourism. Hence the application is adjourned for six weeks. I.A. Nos. 353-354 and 355-356 5. List in the third week of January, 2003. I.A. No. 365 6. To be heard alongwith I.A. Nos. 353-354.
