K. H. N. KURANGA, C. J. ( 1 ) HEARD Mr. Arun Kochar, learned Counsel for the applicant and Mr. R. K. Jojodiya, Panel Lawyer for the State respondent. ( 2 ) A case in Crime No. 117/2001 has been registered in Bagbahara Police Station for the commission of offences punishable under Sections 420, 406/34 and Section 409 read with 34. IPC against the applicant and her husband Bhikham Chand. ( 3 ) THE case of the prosecution is that the applicant is the Sarpanch of Gram Panchayat Shivnikala. A resoludon was passed. In pursuance of the resolution an amount of Rs. 38,000/- was received by the husband of the applicant i. e. , Bhikham Chand. The amount was not repaid. The applicant and bhikham Chand misappropriated the same. ( 4 ) IT is submitted that Bhikham Chand, the co-accused has already been released on bail by this Court by order dated 23/11/2001 in M. Cr. C. No. 2604/2001 which is not disputed by the Counsel for the respondent. ( 5 ) SINCE the co-accused has already been released on bail and applicant is a lady aged about 36 years. I am of the opinion that she has to be granted anticipatory bail. Accordingly, the application is allowed. ( 6 ) IN the event of arrest of the applicant in Crime No. 117/2001 by the Bagbahara Police for the commission of the aforesaid offences they are directed to release the applicant on bail on her executing a bond in Ia sum of Rs. 10,000/- with two sureties of the like sum to the satisfaction of the police officer arresting her. She shall not tamper with the prosecution evidence. Petition allowed. --- *** --- .
