JUDGMENT : By Court.-A School boy, namely, Sanjay Kumar Turi @ Sanjay Turi died. On 14.8.1992, deceased was going to Kanke on an Auto Rickshaw (BPV 8726), which was dashed by a bus (BPY 4239), coming from the opposite direction. 2. It was proved that accident took place on account of fault of driver of the bus, which belonged to Bihar State Road Transport Corporation. 3. Parents of the deceased filed claim application, under Section 166 of the Motor Vehicles Act, 1988, for compensation. It was claimed that their son was reading in Class-IX but they failed to bring on record any document to show his performance in class as a meritorious student. It was further claimed that he was a sportsman and a player of football. In this regard, a certificate granted by Rain Bow Club, Sindri (Ext. 2) was produced, but nothing was found therein to show that the deceased was a football player. 4. The Tribunal assessed a lump sum amount of Rs. 60,000/- as compensation payable to the claimants with interest @ 12% per annum from the date of filing of claim application till payment. 5. We find no reason to interefere with the impugned judgment and award in this appeal. Accordingly, it is dismissed. No costs.
