ORDER J.S. Kesar, FC. - This Revision Petition was heard on 4.2.2002. However, the learned Counsel for the petitioner wanted to place on record the latest Jamabandi in which the relevant entries regarding possession have been incorporated and the case was reserved for orders. The learned Counsel for the petitioner has filed the copy of Jamabandi for the year 1998-99 and as such the order is being announced today. 2. Under revision is the order dated 20th July, 1999 of Commissioner (Appeals), Jalandhar Division vide which he accepted the appeal of Nasib Chand s/o Shri Bhagat Ram, r/o village Rattewal, Tehsil Balachaur, District Nawanshahar for the reasons given in the impugned order. 3. While arguing, the counsel for the petitioner has pointed out that the entry of possession of the petitioner as per the order of the Collector has been incorporated in the Jamabandi for the year 1998-99. As per ruling reported in 1981 RR 115(xv), Khasra Girdawari entries once entered in the subsequent Jamabandies, the aggrieved party can avail the remedy only in the Civil Court and the jurisdiction of Revenue Officer ceases. I find that the possession of the petitioners has since been entered in the last Jamabandi for the year 1998-99. Hence it is beyond the jurisdiction of this court to interfere in these entries. The learned Commissioner could have taken note of this fact while deciding the appeal. Accordingly the Revision Petition is accepted. If any party has the grievances with the entries in the Khasra Girdawari the Civil Court of the appropriate jurisdiction may be approached. The parties are left to bear their own costs. Announced. Revision allowed.
