P. K. TRIPATHY, J. ( 1 ) THE Senior Manager (Law) Sri P. J. Vajifdar has filed this application under Articles 226 and 227 of the Constitution of India with the prayer to quash the complaint case and the order of cognizance in I. C. C. No. 214 of 1996 of the Court of S. D. J. M. , Bhubaneswar so far as it relates to accused No. 1 in that complaint case. In the complaint the accused No. 1 has described as follows :-"2. Managing Director, Tata Finance Limited, having its office at 24, Homy Modi Street, Mumbai-400 001. 3. Senior Marketing Manager, Tata Finance Limited, Plot No. 192, Unit-3, Bhubaneswar, District-Khurda. 4. Branch Manager, Tata Finance Limited, Plot No. 192, Unit-3, Bhubaneswar, District-Khurda. " ( 2 ) BESIDES this application under Arts. 226 and 227 of the Constitution the selfsame petitioner also moved an application under S. 482, Cr. P. C. registered as Crl. Misc. Case No. 2050 of 1998. As per a separate judgment pronounced today that application has been rejected being not maintainable by the petitioner on the ground that he is not an accused in the said proceeding and he has no locus standi to apply for quashing of the complaint or the order of cognizance. For the self-same reasons the writ application is also not maintainable and accordingly dismissed. Petition dismissed.
