Judgment 1. This Letter Patent Appeal has been filed against the order of 16 January, 2002 on C.W.J.C. No. 582 of 2002 : Kameshwar Singh and Anr. V/s. The State of Bihar & Ors. 2. The issue brought in the petition was that the school which was intended to be established as a primary school should run from a particular building. Obviously there were two buildings claiming rivalry on the aspect as to from where the school should be established. One building was constructed under the Sunishchit Rojgar Yojna and the other building was constructed out of the fund of a Member of the Legislative Assembly. 3. From the petition, it is clear that the Member of the Legislative Assembly had put in his fund for the construction of the building. The petitioners desire that the primary school should be set up within the building. The administration had constructed another building from public funds under Sunishchit Cougar Yojna. This building is approximately 400-500 meters away from the village. 4. The matter basically is one of village politics or of politics itself. This is not a matter in which the High Court should be interfering whether the school should be run from a particular building within the village or a building 400 metres away from the village. In the circumstances, the learned Judge has committed no error in the order passed on the petition. 5. Dismissed.
