JUDGMENT A. A. Desai, C. J. and Irshad Hussain, J. : Heard Sri Alok Singh, learned counsel for the applicant-appellant. 2. The appellants applicants are suffering conviction and sentence for the offence punishable under Sections 302 and 379, IPC read with Section 34, IPC. 3. We have heard appeal against conviction. The same is admissible. 4. The applicants have now pressed for bail. It is reported that the appellants-applicants were on bail during trial and they have not misused the liberty, in any manner. The incident in question occurred in 1992. It is reported that at the relevant time the applicants were students and they are held guilty for murder of their own colleague. 5. Having regard to the background and particularly that the applicants have not misused the liberty while on trial, we direct that the appellants, namely, Sanjeev Gupta @ Sonu Gupta and San deep Vashisht be released on bail in case Crime No. 498/1992 under Sections 302/34 and 379, IPC, P. S. Rishikesh, District Dehradun, on each of their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate concerned.
