ORDER S.J. Mukhopadhaya, J. 1. This application has been preferred by the petitioner for direction on the respondents to pay him the retiral benefits and time bound promotion to which the petitioner was entitled under the law. 2. The case of the petitioner is that he was appointed as Overseer (Junior Engineer) to which post he joined on 14th August. 1973 and continued in the said post till the date of retirement i.e. 31st July, 2001. 3. Though, the petitioner was eligible and entitled for time bound promotion to the next higher grade, but he was not given such benefit, though vide Memo dated 16th October. 2001. his pay has been fixed at Rs. 7,700/-on grant of increment w.e.f. 1.4.1997. 4. As the issue aforesaid requires determination by the Respondents, the case is remitted with liberty to petitioner to approach the Secretary. Water Resources Department. Government of Jharkhand, Ranchi giving details relating to his service career, including the date of appointment, promotion, if any to the higher post and last place of posting, as well as pay drawn. 5. The Secretary, in his turn, will determine the issue as to whether the petitioner was entitled for any time bound promotion and as to why the retiral benefits have not been paid in favour of petitioner and pay the admitted dues, including the retiral benefits within four months from the date of receipt of representation. 6. In case the admitted retiral benefit is not paid within the time schedule above, the Respondents will be liable to pay interest @5% from the date of retirement. 7. On the other hand, if the authorities reject any claim will forward the ground to the petitioner within the period aforesaid. The writ petition stands disposed of.
