JUDGMENT A.A. Desai, C.J. and Irshad Hussain, J. 1. Heard Mr. Manoj Tewari, learned counsel for the petitioner. 2. According to Sri Tewari, the petitioner is holding the post of Deputy Development Officer. He was eligible and entitled to be considered for the post of the Chief Development Officer. However, his claim was not considered and other persons, who were junior to him, have been promoted by the State Government. 3. Heard learned chief standing counsel. According to him, the character roll of the petitioner was not available with the department as he has opted for Uttaranchal. As such, he was not taken to the zone of consideration of promotion. 4. Learned chief standing counsel further made a statement that on receipt of the character roll, the petitioner on the merit will be considered for promotion and if he is due for promotion at the relevant date and time, he will be given deemed date of promotion. In view of this statement as made, the grievance of the petitioner does not subsist. However, we direct that the respondent State Government shall take decision in the matter preferably within a period of eight weeks. 5. The petition is disposed of accordingly.
