Judgment 1. The court need not notice anything more except to place the decision of the Supreme Court on record. 2. Agreeing wholly with the order of the learned judge dated 13 February 2002 on CWJC No. 574 of 2002, the court finds no error in the order. The petitioner-appellant should be thankful that he got a job in an exceptional circumstance on the death of his father on compassionate ground. This is the third writ petition of the petitioner-appellant seeking equality with persons who are otherwise qualified and did not come through the back door. 3. All that is necessary is that the decision of the Supreme Court needs to be noticed that compassionate appointments are made in exceptional circumstances and do not give those persons terms of equality with persons who have qualified for the job. The decision of the Supreme Court in re. Scientific Advisor to Raksha Mantri V/s. V.M. Joseph, 1998 (5) S.C.C. 305 , which notices another decision in re. which the decision Union of India and others V/s. C.N. Ponnappan, AIR 1996 S.C. 764 , applies to this matter. The learned judge committed no error in dismissing the writ petition. 4. Dismissed.
