ORDER S.J. Mukhpadhaya, J. 1. This writ petition has been preferred by the petitioners for direction on the respondents to reinstate them as juniors having allowed to continue and the petitioners having removed. 2. The case of the petitioners is that they were engaged in the Water Resources (Irrigation) Department of the State of Bihar on daily wage between 1979 to 1985, details of which have been shown in Annexure-1/1. They were allowed to perform the duties of Class-111 and IV posts. 3. As per policy decision of the State Government for absorption taken vide letter No. 8016 dated 17th December, 1985, the names of petitioners were recommended for absorption. No step having taken, the petitioners preferred writ petition C.W.J.C. No. 6360/88 and CWJC No. 722/89 before the Patna High Court which were disposed of by Division Bench on 12th March, 1993. 4. Thereafter, though persons engaged after engagement of petitioners have been retained in service and regularised. The petitioners were removed in the year 1994. 5. It is stated that when the petitioners preferred review application being Civil Review No. 272/79, the Patna High Court observed that the removal will not affect in the matter of regularisation of services of petitioners. 6. The counsel for the parties produced an order passed by the Supreme Court in State of Blhar and Ors. v. Laghu Sichai Karmchari Sangh and Ors., in S.L.P. (Civil) No. 18164/99 and analogous cases on 30th October, 2000. That was a case related to daily wage Choukidars. Pump Operators who were engaged between 1980-1985. The State of Bihar framed a scheme, vide Resolution No. 5940 dated 18th June, 1993 for regularisation of services of the employees who were engaged prior to 1st August, 1985 and completed 240 days. 7. As per the Resolution, certain directions were given by the learned Single Judge which was followed by certain orders passed by the Division Bench of Patna High Court, against which the State of Bihar moved in appeal. 8. Taking into consideration the Scheme dated 18th June, 1993, the Supreme Court directed the State of Bihar to take steps to constitute a committee for implementation of the Scheme dated 18th June, 1993 depending upon the number of vacancies available, from time to time. 9.

It is stated that after Reorganisation of the State and creation of the State of Jharkhand, the State of Jharkhand from its Water Resources Department vide letter No. 10/2001 dated 9th October, 2001 (forwarding Memo No. 2159 dated 7th November, 2001) asked all the Chief Engineers of Water Resources Department, Jharkhand, Ranchi to forward the list of daily wage employees who are engaged prior to 1st August, 1985 on the basis of their seniority and strength of posts. 10. It appears that steps have already been taken to implement the Supreme Courts order as per Scheme dated 18th June, 1993. 11. Having regard to the facts and circumstances, as the petitioners claim that they were working in the Santhal Parganas region which now falls within the State of Jharkhand. they are given liberty to bring the matter along with this order as well as the order of the Supreme Court to the notice of the Secretary, Water Resources Department, Government of Jharkhand. Ranchi who, in its turn will consider the cases of petitioners and to determine as to whether they are also covered by the Supreme Courts decision in S.L.P. (Civil) No. 18164/99, the Resolution No. 5940 dated 18th June, 1993 and their cases are required to be considered along with those named, as has been called for vide letter No. 10/2001 dated 9th October, 2001 or not and determine the issue within six months. 12.
