Judgment P.K.Deb, J. 1. Heard the parties. 2. In all these cases claims and grievances of the petitioners are almost same and similar and the respondents are also the same. It is submitted in the Bar that these cases are similar to the batch cases in CWJC No. 14857 of 2001 and others which were disposed of vide order dated 14-12-2001 and, as such, these batch cases may also be disposed of with the same direction and observation. On independent scrutiny of all these cases, I also find that the petitioners in these cases stand on the same footing as that of the others whose cases were disposed of on 14-12-2001 in the batch cases as already mentioned above. In that way, the present writ petitions are also disposed of with the same direction as has been made in the batch cases as mentioned above. 3. The individual petitioners shall file representation before the District Superintendent of Education, Jahanabad and also the District Superintendent of Education, Gaya within a period of six weeks from this date along with a copy of this order and those representations should be disposed of by the respectively District Superintendent of Education within a period of four weeks next thereafter on giving personal hearing to the individual petitioners. The amounts which had been accumulated are still laying with the District Superintendent of Education, Gaya. The same should be transferred to the District Superintendent of Education Jehanabad from where payments are to be made within a period of eight weeks along with the statutory interest from the date of due till the date of realisation. 4. It is further made clear that the District Superintendent of Education, Gaya should see and find outfrom his records whether the schools which were originally run by him and the Municipal Corporation and whether the accounts accumulated had been transferred to the District Superintendent of Education or not. If not, he should get it transferred within a period as mentioned above to the District Superintendent of Education, Jehanabad. In some of the cases, it appears that the salary differences have already been made available to some of the petitioners but interests have not been paid. Such statutory interest should also be made available to them within this period as mentioned above. 5.
In some of the cases, it appears that the salary differences have already been made available to some of the petitioners but interests have not been paid. Such statutory interest should also be made available to them within this period as mentioned above. 5. It is further made clear that amount which has been sanctioned for satisfying the grievances of the petitioners by the State Government may not be sufficient for the purpose of giving relief to the individual petitioners of these batch cases along with the other batch cases as already disposed of. Then requisition should be made to the State Government within the period as mentioned above and the State Government through Secretary Finance shall act on the requisition made either by the D.S.E., Gaya or D.S.E., Jehanabad for disposal of the grievances of the petitioners and the similarly situated persons once for all. 6. These writ petitions are disposed of accordingly.
