JUDGMENT : IA 111 in WP(C) 13381/84 1. In the affidavit dated 7th April, 2002 filed by the Principal Secretary, Government of Uttar Pradesh, Home Department Civil. Secretariat Lucknow, UP, last paragraph reads as under: "The state Govt. would have no objection to internal security of Taj Mahal being taken over by a professional and trained central force such as C.I.S.F. engaged and paid by the A.S.I. as enunciated in para.7 of A.S.I. Affidavit. However, the security schemes prepared by such agency would have to be vetted by the State Security Branch and the Intelligence Bureau, Government of India. The security scheme should also provide for coordination with district administration and regular inspection and supervision by state security branch and Intelligence Bureau, Govt. of India. As and when such central Govt. Agency takes over the task of internal security of the Taj with its paraphernalia as required, the state police would remove its deployment, along with its equipments, presently being used for the same duty. The state police would thereafter continue to provide peripheral security outside the monument for crowd control and maintenance of law and order. Any other assistance which the A.S.I. and its agency may require from time to time would also be provided. Prevention, Registration and Investigation of crimes inside the premises would also continue to be done by the state police amongst other duties prescribed under the law." 2. In this view of the matter, A.S.I. is directed to submit the proper scheme for engaging C.I.S.F. to safeguard the Taj premises and Taj Complex within two weeks from today. 3. Copy of the scheme prepared by A.S.I. would be handed over to the learned counsel for the State of UP within two days from today. 4. Stand over for two weeks. IA Nos. 125 and 132 in WP(C) 13381/84 5. At the request of learned counsel for the CPCB these IAs are adjourned for three weeks for submitting the report.
