JUDGMENT Irshad Hussain, J. : Heard the learned counsel for the applicant and the learned A.G.A 2. Applicant-accused was not named in the FIR and according to the prosecution, stolen ornaments have been recovered from his possession. The details of the ornaments were not given in the F.I.R. and till the statement of the complainant was recorded after three days under section 161 of Cri.P.C. no detail of the ornaments was submitted to the Investigating Officer. Considering this aspect. I find it a fit case for bail. 3. Let the applicant Sher Mohmmad alias Sheru son of Sri Rasheed, R/o Bamanwala, P S. Kotwali, District Dehradun be released on bail in case crime No. 30 of 2002 under Sections 395, 397, 412 of I.P.C., P.S. Dalanwala, District Dehradun on his ling a person bond and adequate sureties to the satisfaction of C.J.M. Dehradun.
