JUDGMENT Looking to the nature of evidence with respect to ransom payment, prosecution evidence is not satisfactory. PW 2 Jamuna Prasad, brother of complainant, in his statement in Court has stated that he paid Rs. 1,00,000/- in two instalment but this does not find mention in his statement under section 161 Code of Criminal Procedure. Consequently, applicant is directed to be released on bail during pendency of appeal subject to following conditions: (1) that he shall furnish a personal bond of Rs. 15,000/- (rupees fifteen thousand) with two sureties in the like amount each to the satisfaction of trial Court undertaking to appear in that Court on 2nd day of each month during pendency of appeal and record his presence. In case 2nd day of any month happens to be holiday or the Court does not sit on that day for any reason, he may appear on the following day. In case the applicant fails to do so, the trial Court will inform this Court and the matter will be considered for cancellation of bail; (2) that he will not repeat the offence and shall maintain peace and good behaviour with his neighbours during the period of his release on bail; and (3) that he will not leave jurisdiction of this Court unless permission is granted by this Court.
