JUDGMENT 1. - Heard learned counsel for the accused-petitioners and learned Public Prosecutor at the admission stage. It was contended that challan u/s. 19/54, Rajasthan Excise Act was filed in absence of the accused. Criminal Case No. 327/94 State v. Sohan Lal & Ors. , is pending in the Court of ACJM, Fatehpur, District Sikar and the warrant of arrest were issued against the accused-petitioners. It is prayed that the accused-petitioners never knew about this challan, therefore, the warrant of arrest may be converted in bailable warrant. 2. Learned Public Prosecutor has opposed this prayer. Looking to the facts and circumstances of this case, this petition is allowed and it is ordered that the trial Court shall issue bailable warrant in the sum of Rs. 5,000/- instead of warrant of arrest. 3. With the aforesaid jurisdiction this petition is disposed of accordingly.Petition dismissed. *******
