JUDGMENT 1. - Heard learned counsel for the parties. 2. Bhanwari Devi, respondent No. 3 herein, filed a revenue suit for cancellation of registered sale deed dated 14.3.1968 as also for possession of the suit land before assistant Collector, Bali in which Bhagwati Devi, petitioner herein, alongwith other defendants filed written statements submitting inter-alia that the suit for cancellation of registered sale deed cannot be decreed by the revenue court. Numerous issues were framed and thereafter the learned trial court vide order Anx.4 returned the suit for presentation before the Civil Court. Aggrieved against that order Bhanwari Devi filed and appeal before the Revenue Appellate Authority and thereafter a revision petition before the Board of Revenue which were also dismissed vide orders Anx.5 and Anx.6 respectively. A review petition was also filed in the Board of Revenue which was accepted vide order Anx.7. Hence this petition under Article 226 of the Constitution of India. 3. Though the submissions of the learned counsel for the petitioner are well founded that the review jurisdiction is limited to the extent of correcting error apparent on the face of record, however, it is still the legal position that a suit for cancellation of the registered sale deed lies in the jurisdiction of the civil court and not that of the revenue court. 4. In such a situation this petition stands disposed of with the direction to the Assistant Collector, Bali to try the suit himself. However, the issue with regard to cancellation of sale deed may be referred to the civil court for decision under Section 239 of the Rajasthan Tenancy Act.Writ Petition Disposed of as above. *******
