ORDER : DIRECTIONS WITH REGARD TO AFFIDAVIT FILED BY INDRAPRASTHA GAS LIMITED 1. In the affidavit filed by the I.G.L. in Annexure-B the build up of C.N.G. price has been indicated which is as follows :- Build up of CNG price (Figures in Rs. per kg.) Cost of Natural Gas : 5.41 Fixed Operating Cost : 4.70 Other Cost : 6.72 (Variable operating cost, return on equity @ 10% & statutory levies) TOTAL : 16.83 2. The learned Amicus Curiae submits that full particulars are not given which can justify the increase in the price from Rs. 5.41p. per kg to Rs. 16.83p. per kg. If the figures indicated are correct on the basis of disposing of 9.5 lacs kg per day, I.G.L. would be getting approximately Rs. 1 Crore per day in excess of the cost of natural gas calculated at Rs. 5.41p. per kg. 3. Bhure Lal Committee is requested to investigate the pricing of the C.N.G. as done by the I.G.L. and give report to this Court whether there is any justification for the figure of Rs. 16.83p. per kg. In giving this report, the Bhure Lal Committee should take into consideration the price at which petrol, diesel and kerosene are sold in Delhi. It will also indicate as to what is the extent of subsidy or cross-subsidisation, if any, given by the Central Government in respect of petrol, diesel or kerosene as compared to C.N.G. 4. Learned Amicus Curiae draws our attention to the practice which is prevalent in some other countries to the effect that tax concessions are given in respect of CNG so as to encourage the use of the said fuel in an effort to bring down pollution, a topic about which the Government seems to have little concern. Report of the Bhure Lal Committee be submitted within eight weeks. The Indraprastha Gas Limited and the Union of India shall furnish to Bhure Lal Committee any particulars which are asked for by the said Committee. The Bhure Lal Committee will be at liberty to take assistance from any Cost Accountant or any other expert in the matter. DIRECTION WITH REGARD TO THE AFFIDAVIT FILED BY THE UNION OF INDIA 5.
The Indraprastha Gas Limited and the Union of India shall furnish to Bhure Lal Committee any particulars which are asked for by the said Committee. The Bhure Lal Committee will be at liberty to take assistance from any Cost Accountant or any other expert in the matter. DIRECTION WITH REGARD TO THE AFFIDAVIT FILED BY THE UNION OF INDIA 5. Union of India will give a scheme with regard to compulsory switch over of all two wheelers, three wheelers and motor vehicles to L.P.G/C.N.G. in cities other than Delhi which are equally or more polluted.
