body2002
ORDER N.K. Jain, C.J.--This Habeas Corpus is filed by one Pradeepa Kumara resident of Pambar House, Kolthige Village, Puttur Taluk, D.K. District alleging to be the proposed husband of one Kumari Prashanthi praying to direct the Respondents to produce Kumari Prashanthi and set her at liberty. 2. It is stated in the Petition that the Petitioner Pradeepa Kumara and Kumari Prashanthi decided to marry against the wishes of the elder members of the family and on 14.11.2002 at about 9.30 a.m. when the Petitioner and Kumari Prashanthi were proceeding towards the Wedding Hall along with their friends and well wishers, suddenly the father and brother of Kumari Prashanthi i.e., Respondents 5 and 6 obstructed the Petitioner and Kumari Prashanthi with the help of some unknown persons who came in a jeep bearing Registration No. KA-21/9786 and stopped on the midway near a place called Kumbra of Puttur Taluk and threatened the Petitioner with dire consequence and took Kumari Prashanthi from the custody of the Petitioner. Therefore the Petitioner prays for a direction to the Respondents to produce Kumari Prashanthi before this Court. 3. On consideration we find that the Petitioner has no locus-standi to file this Writ Petition and hence no direction can be issued. Moreover, the matter is still pending investigation. Hence this WP is dismissed. However, the dismissal of this Writ Petition will not preclude the Respondents to take appropriate action according to law.
