JUDGMENT 1. - This bail application u/s. 439 Cr.P.C. has been filed on behalf of the petitioner against whom trial is pending in the Court of Additional Sessions Judge (Fast Track), Pratapgarh in Sessions Case No. 210/2001 for the offence u/ss. 302/120-B & 201 IPC. 2. The allegation against the petitioner is that he along with other co-accused persons committed the murder of Kalu Ram @ Bapu Lal and after severing his head from the dead body concealed the dead body and the head separately which was recovered pursuant to the information of the petitioner and Jai Ram. 3. Learned counsel for the petitioner has contended that the petitioner is in custody since 11.3.2001 and the trial will take time to be completed. He has also contended that his name has not been given by the witnesses whose statements have been recorded in the Court so far. Learned Public Prosecutor has opposed the bail application on the ground that the trial is proceeding fast and would be completed shortly. 4. Having considered the submissions made at the bar and upon a perusal of the case diary and all other facts and circumstances of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 5. Therefore, this bail application is allowed and it is directed that the petitioner-Tulsi Ram be released on bail provided he executes a personal bond in the sum of Rs. 20,000/- with a surety in the like amount to the satisfaction of the learned trial Court fox his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.Bail application allowed. *******
