JUDGMENT : 1. We have heard learned Amicus Curiae qua the States of Haryana, Punjab, Karnataka, Gujarat and Madhya Pradesh. We request the learned Advocates General/ standing counsel for these States to carefully peruse the reports submitted by the Sub-Committees constituted by the Chief Justices of the respective High Courts to find out the omissions/non-compliances pointed out in these reports, have specific instructions in that regard as to why the omissions/non-compliances are persistent and what action, if any, has been taken against the officials found responsible for omission or non-compliance. They should have full instructions to make submissions in that regard on the appointed date of hearing. They may also file appropriate affidavits dealing with the omissions and non-compliance in the light of this order and the previous orders of this Court. 2. At the same time, we expect the Commissions/Committees to continue with their inspections which ought to be by way of surprise checks carried out in day and night too by atleast two members acting together. The focus shall be on seeing compliance with directions of this Court as also noticing violation of any human rights including custodial violence. 3. We have perused the document entitled "Second Report" dated 20.3.2002 from the State Human Rights Commission, Madhya Pradesh, Bhopal. We request the Commission to bring to our notice any specific instance with particulars, making out a sound case for exemplary action by this Court. 4. In case of arrest of a person, the record of the police station should reveal, who and in what manner was informed of the arrest of any one arrested so as to cross-check in case of need. 5. A copy of this order be made available to the learned Amicus Curiae and also sent to the Chief Secretaries of all the abovesaid five States. 6. List after six weeks. Crl.M.P.
