ORDER Karl Reddy, F.C. - This is a petition under Section 16 of the Punjab Land Revenue Act, 1887 seeking to revise the order dated 29.12.2000 of the Additional Commissioner (Appeals), Jalandhar Division, Jalandhar, and to restore the order dated 13.6.2000 of the S. D. M.-cum-Collector, Amritsar- II, in proceedings for correction of Khasra Girdawari of land measuring 67K 18M situated in the revenue estate of Verka, Tehsil and District Amritsar, w.e.f. Rabi 2000. 2. The petitioner filed an application for correction of the Khasra Girdawari entries in his favour w.e.f. Kharif 1999. This was allowed by the Assistant Collector IInd Grade, Amritsar vide order dated 4.1.2000. Admittedly no notice was given to the respondent who is the father of the petitioner and a Non- Resident Indian. 3. The respondent filed an appeal before the Collector against that order. During the pendency of the appeal, he filed an application before the Assistant Collector Ist Grade for correction of the Khasra Girdawari in his favour w.e.f. Rabi 2000. This was allowed vide order dated 29.3.2000 without notice to the petitioner. The respondent then had the pending appeal dismissed as withdrawn vide order dated 11.4.2000. The petitioner has taken exception to such happenings. Hence the present petition. 4. The Khasra Girdawari entry for Kharif 1999 will continue in favour of the petitioner, the appeal in respect thereof having been dismissed as withdrawn. However, there does not appear to be any bar to the respondent filing an application for correction of Khasra Girdawari entries for the subsequent crop. No doubt the Assistant Collector Ist Grade erred in dancing to NRI Sabha tunes and ordering correction without notice to the petitioner, but on facts the respondent is owner in possession as per the Jamabandis from 1966-67 till date, and only a stray entry for Kharif 1999 is against him. Accordingly, the petition is dismissed. To be communicated. Petition dismissed.
