Judgment ( 1. ) OFFICE has reported that the appellant has not duly filled up vakalatnama. From the perusal of the Vakalatnama, it appears that at the place of description of person appointing an Advocate, the word "appellant" has been written only. The full name, age and address of the person who appointed the counsel has not written. This has caused confusion whether the person who has signed the Vakalatnama is the same person whose name is appearing as appellant in the cause-title. ( 2. ) FROM the perusal of the other files also, I have found that the vakalatnamas are being filed in following manner:- (1) On half of the full scape paper. (2) Improperly filled up. (3) Court fee or Advocate Welfare Fund Stamps are affixed on vakalatnama in such a manner by which the authority given in the Vakalatnama is covered and can not be read. (4) Signatures are put in such a manner that it could not be ascertained whose signatures are they. (5) Executants and Advocates are not putting their names just below the signatures. (6) Thumb impression is not verified. This is not proper. In the circumstances, office is directed to observe following:- (A) All the Vakalatnamas are filed in accordance with rule under section 34 (1) of the Advocates Act framed by the High Court on 28th February, 1967 published in M. P. Rajpatra on 23rd august, 1968. (B) All the Vakalatnamas will be filled on thick paper of full scape size and one side of paper will be used. (C) The Vakalatnamas will specifically show the name, age, fathers name and address of person/persons appointing the counsel. (D) Court fees and Adhivakta Kalyan Nidhi ticket will be affixed either on the top of Vakalatnama or on the side of Vakalatnama in such a manner so that they will not cover or overlap the authority extended by Vakalatnama. (E) The person signing the Vakalatnama will also put his name just below his signature. This will apply to both the persons executing the Vakalatnama and also Counsel accepting the vakalatnama. (F) In case the Vakalatnama is not filed in accordance with aforesaid direction, the office will place the matter before Registrar (Judicial), who will afford an opportunity to the concerned to rectify the defect and in default of which matter will be placed before the Court for passing appropriate orders in this regard.

( 3. ) AT this stage, learned Counsel for appellant seeks permission to make the default good in Vakalatnama. In the interest of justice, prayer allowed. ( 4. ) SHRI Manoj Mishra, Advocate submits that he has filed caveat on behalf of respondent No. 2. Appellant is directed to supply copy of memo of appeal to the Counsel appearing for caveator. ( 5. ) A copy of this order be sent to High Court Bar Association, jabalpur, Indore and Gwalior for information to the Members of the Bar.
