Judgment H.S.Bedi, J. 1. Petitioner No. 1 is a doctor, who at the relevant time, was posted as a Medical Officer in the General Hospital, Bhiwani, whereas petitioner Nos. 2 and 3 were Staff Nurses working in the same Institution. Respondent No. 2 Varinder Singh is a practising Advocate. A child born to his wife died during the course of delivery. An FIR No. 569 dated 25.12.1998 was thereafter lodged in the Police Station, Bhiwani. The present petition has been filed seeking the transfer of the case from Bhiwani to some other district on the plea that as per a resolution passed by the District Bar Association, Bhiwani, no lawyer could conduct the case on behalf of the accused as the complainant was an Advocate and the matter pertained to a criminal offence. It has been pointed out by the petitioners that one Shri R.C. Gugnani Advocate, who had been engaged by them had also expressed his inability to continue with the case. 2. Notices have been duly received by the respondents. Varinder Singh Advocate, respondent No. 2, is not present despite service. In this view of the matter and on the basis of the allegations made by petitioners, I deem it appropriate that the trial be transferred to a competent Court in district Rohtak. The Criminal Misc. is, therefore, allowed and the Sessions Judge, Bhiwani is directed to forward the record of the case to the Sessions Judge, Rohtak for appropriate action.
