ORDER : 1. UPON hearing counsel the Court made the following 2. Heard learned counsel for the applicants. 3. On 28-4-2001 this Court passed the following order : "Shih Mei Tannery and 229 other Chinese Tanneries to deposit with this Court Rs. 6,54,865/- forthwith towards expenses incurred by the Central Leather Research Institute as directed in the order dated 21.4.2001. This amount shall, however, be deposited without prejudice to the contention that they have no liability to pay the same." 4. It is apparent from the aforesaid order that Shih Mei Tannery and 229 other tanneries were directed to deposit Rs. 6,54,865/- towards the expenses incurred by the Central Leather Research Institute. Pursuant to that order the State Government reimbursed a sum of Rs. 4,89,000/- by demand draft issued in the name of Shih Mei Tannery and the said amount is still lying in the Account of Shei Mei Tannery at Punjab and Sind Bank, Tangra Branch, Kolkata. In this view of the matter, Shih Mei Tannery is directed to transfer an amount of Rs. 4,89,000/- to Tangra Effluent Treatment Plant Fund for disbursement to the concerned Tanneries, within two weeks from today. 5. Further, for laying down the Effluent Transportation System the work would be carried out by BOT party as per the schedule. In the Record Note of discussions held on 6th August, 2002, between the Ministry of Environment and Forests, Government of India, State Government and the BOT Agency, to resolve the grievances in respect of construction of CETP in CLC Calcutta, it has been stated that the estimated cost of effluent pipeline and treated effluent disposal pipeline would be Rs. 3.47 crore in Zone Nos.1 to 8 which would be equally borne by the State Government and the Central Government. 6. Hence the aforesaid amount be paid to the BOT Party within one month from today by the Central Government as well as by the State Government. As far as the construction of the said pipelines in Zone Nos.9, 10 and 11 is concerned, the State Government and other interested parties would file the necessary affidavits within four weeks. 7. Further, the share of the Central Government be paid to the BOT party through the State Government. Stand over to 20th September, 2002.
