MUKUL MUDGAL J. ( 1 ) ( 2 ) WITH the consent of the counsel for the parties, the writ petition is taken up today for final hearing. ( 3 ) THIS writ petition challenges the Award dated 5th May, 2000 directing the payment of functional allowance to the workman, Shri Krishan Pal for the period, starting from 21st May, 1990 to 22nd June, 1991 including the payment of special allowance for the month of May, 1991 to June, 1991. ( 4 ) LEARNED counsel for respondent No. 2 has no objection to the setting aside of the Award dated 5th May, 2000, subject to the payment of the costs. ( 5 ) CONSIDERING the facts and the circumstances of the case and the passage of time and the fact that the reference is pending since 1995, the award dated 5th May, 2000 and Orders 10th March, 1998, 5th April, 2000 and 2nd May, 2000 are set aside subject to the payment of the costs, quantified at Rs. 10,000. 00 payable to the respondent No. 2. ( 6 ) PARTIES are directed to appear before the Central Government Industrial Tribunal, New Delhi on 9th December, 2003. The costs be paid within 4 weeks and in any event not later than 9th December, 2003. ( 7 ) ACCORDINGLY, the petition stands allowed and disposed of.
