Judgment ( 1. ) PETITIONER in this writ petition is claiming for the relief to direct the university not to ask the petitioner appear in the papers of first semester of bca Counsel for petitioner has not pressed for relief made in Para 7. 1 as petitioner has passed 4th semester paper during the pendency of this writ petition. ( 2. ) PETITIONER was admitted to second semester in the Makhanlal chaturvedi Rashtriya Vishwavidyalaya, respondent No. 1. Petitioner has by now completed 6th Semester. Petitioner was required as per letter (P-9) dated 26-10-2002 to clear the papers of BCA first semester of Makhanlal Chaturvedi rashtriya Vishwavidyalaya. ( 3. ) IT is conceded by Counsel for the petitioner that there are three papers which petitioner has not cleared, but, submission is that the petitioner has disclosed the fact of passing of first semester from Rani Durgawati vishwavidyalaya. Thus, the respondents be restrained from the petitioner from appearing in the subject which he has not cleared. ( 4. ) THE stand of the University, respondent No. 1 is that equivalence is required to be made in the case of change of University and certain papers have not been cleared by petitioner. It is further contended in the return that the petitioner has failed in one of the subject in Rani Durgawati vishwavidyalaya and applied for admission in BCA course conducted by respondent No. 1, Makhanlal Chaturvedi Rashtriya Vishwavidyalaya. The very important fact the subjects taught are included in first semester of BCA course of Rani Durgawati Vishwavidyalaya were substantially different as compared to the papers included in the curriculum of respondent No. 1, University. ( 5. ) AFTER hearing learned Counsel for the parties, in my opinion, petitioner has to clear those papers which are substantially different and were not prescribed in Rani Durgawati Vishwavidyalaya as question of equivalence is also relevant and important for conferral of degree by respondent No. 1, university. If petitioner is desirous of obtaining the degree of BCA from makhanlal Chaturvedi Rashtriya Vishwavidyalaya, obviously he has to clear the papers prescribed for the course by the University. ( 6. ) IT is directed that let the University inform the papers specifically which the petitioner has not cleared within 3 weeks from today, which the petitioner has to clear in order to entitle him to obtain the degree of BCA from makhanlal Chaturvedi Rashtriya Vishwavidyalaya, respondent No. 1.
