JUDGMENT 1. - The instant writ petition has been filed seeking a direction to 1 quash the corrigendum (Annex.6) and directing the respondents to hold selection proceedings by adhering to the vacancies structure as advertised vide Annex. 1 to 5 and restraining the respondents from raising the reservation of vacancies for S.C., S.T. and O.B.C. candidates beyond the prescribed limit. 2. The facts and circumstances giving rise to this case are that the respondents issued advertisements Annex.1 to Annex.4 for direct recruitment the posts of Senior Teachers in various subjects. The petitioners submitted their applications for appointment on the post of Senior Teacher in English. The respondents issued a corrigendum Annex. 6 increasing the reservation of posts for Scheduled Caste, Scheduled Tribes and O.B.C. candidates and reducing the posts for the candidates of General Category. Hence this writ petition. 3. Reply has been-filed by the respondents stressing on the Circular 15 d:. 9.12.2000 issued by the State Government, which provides treatment of back log vacancies reserved for scheduled caste and scheduled tribes as distinct group and non-applicability of 50% ceiling thereon and therefore, by introducing amendment by way of issuing Annex.6, they have invited applications for filing up the back log vacancies reserved for scheduled castes and scheduled tribes candidates which shall be treated as a separate and distinct group and will not be considered together with reserved category of the year. Respondents have also placed reliance upon the order and direction issued by the Department of Personnel on 14.12.2000, which provided that the action may be taken immediately for filling up the identified back log vacancies for the Scheduled Castes and Scheduled Tribes candidates and the same is in consonance with the provisions of Articles 13(3)(a) and 16(4-B) of the Constitution of India. 4. I have heard learned counsel for the parties and perused the record. 30 A perusal of the reply makes it clear that the corrigendum Annex.6 has been issued to fill up the back log vacancies for the scheduled castes and scheduled tribes candidates.

The advertisements issued for filling up vacancies of Senior Teachers are related to direct recruitment, therefore, in the event of non-availability of eligible and suitable candidates amongst the scheduled castes and scheduled tribes candidates, as per Rule 7 of the Rajasthan Educational Subordinate Service Rules, 1971 the vacancies for such candidates can be carried forward to succeeding three years and as such, the respondents are legally correct and justified in issuing the corrigendum Annex.6. No case for interference is made out. 5. The writ petition lacks merit and it is accordingly dismissed, however, with no order as to costs. *******
