Sanju Devi v. State Of Bihar

2003-12-16

RAVI S.DHAVAN, SHASHANK KR.SINGH

body2003
Judgment 1. Less said is better about the appeal which has been presented by widow of a constable who apparently had his case examined twice, once in a departmental proceeding and thereafter he filed a writ petition (C.WJ.C. No. 9356 of 1994) after which the matter was remitted for examination afresh. 2. Now the widow desires that the matter be examined again. The petitioners husband faced certain charges of misdemeanour of service. While he was trying to explain that he had taken leave and perhaps show an alibi that he was in a hospital it was found that he had slipped away from the hospital and this had brought another misconduct. In the inquiry he produced no witness. Further, during the period when he slipped away from the hospital he was caught at the railway stations platform. This much should be enough for the Court not to interfere with the order of the learned Judge of 27 June, 1997. 3. Dismissed.
