ORDER M.M. Kumar, J. - This petition filed under Section 438 of the Criminal Procedure Code, 1973, seeks pre-arrest bail in case FIR No. 153 dated 10.8.2003, under Sections 420/465/467/468/471/120-B of the Indian Penal Code, registered at Police Station City, Phagwara, District Kapurthala. 2. After hearing the learned counsel for the parties and perusing the enquiry report submitted by Shri Laxmi Kant Jha, Superintendent of Police (HQs), I find that there has been some dispute between the finance company and the petitioner with regard to payment of instalments in respect of the vehicle purchased by him. In this respect the police has hardly any role to play. The other allegation that the petitioner has used a fake number on the car, could be pursued against the petitioner in accordance with law. However, that would not prevent the petitioner to avail the benefit of Section 438 Criminal Procedure Code Accordingly, the petitioner is granted pre-arrest bail. In case he is arrested by the Investigation officer in case FIR No. 153 dated 10.8.2003, he shall be released on bail after accepting bail bond to his satisfaction. He must join the investigation and appear before the Investigation Officer on 27.9.2002 at 10 A.M. or on any other date as desired by the Investigation Officer. He shall abide by the following conditions :- (i) that he shall make himself available for interrogation by the investigation officer as and when called; (ii) that he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer; and (iii) that he shall not leave India without the previous permission of the Court concerned.
