JUDGMENT 1. - The instant writ petition has been filed seeking direction to the respondents to amend the Pension Payment Order by enhancing his pension and grant consequential benefits including payment of arrears with interest. 2. Petitioner was working as Inspector in the Co-operative Department and vide order dated 1.12.1994, he was deputed as Vikas Adhikari in Panchayat Samiti, Riya. He retired form the post of Vikas Adhikari on 30.4.1996 and at the time of his retirement, his basic pay was Rs. 3100/- but he has been granted the pension on the basis of the last pay drawn in the parent department, i.e. Rs. 2975/-. He made representation for granting him revised pension treating his basic pay as Rs. 3100/- but to no avail. Hence this writ petition. 3. The controversy involved in the instant case stands squarely covered by the decision of a coordinate Bench of this Court in Manohar Lal Jain v. State of Rajasthan & Anr., SBCWP No. 2525/1997 decided on 26.03.2002 , wherein this Court held as under: "For the purpose of rule 250, 250-C and 7(24), for the purpose of calculating pension, the emoluments have to mean the pay which the officer was receiving immediately before his retirement. The pay, which was being received immediately before his retirement, was obviously that of Vikas Adhikari, and it is not in dispute that the Last Pay Certificate was factually rightly issued on the basis of the petitioner being Vikas Adhikari. in this view of the matter. it is held that the petitioner is entitled to the retiral benefits on the basis of the Last Pay Certificate." 4. Consequently, the writ petition is allowed and the respondents are directed to grant appropriate pension to the petitioner on the basis of the Last Pay Certificate, i.e. Rs. 3100/- per month, the pay drawn as Vikas Adhikari within a period of three month,: from the date of production of certified .copy of this order. There shall be no order as to costs. Stay petition stands disposed of.Writ Petition Allowed. *******
