JUDGMENT 1. - The instant writ petition has been filed seeking a direction to the 1 respondents to consider the case of the petitioner for appointment on the post of Teacher Grade ill and provide him appointment from the date less meritorious persons were provided appointment, with all consequential benefits. 2. The facts and circumstances giving rise to this case are that the petitioner, after qualifying Secondary School Examination, passed the Senior Secondary (Vocational) Examination and qualified the Bridge Course for said examination in 2000. He has also to his credit the training of S.T.C. In pursuance to the advertisement issued by the respondents in the year 10 1998-99, he applied for the post of Teacher Grade Ill and as per the procedure of selection, his percentage of marks comes to 73.64 but he has been denied appointment on the ground that he had passed the Senior Secondary (Vocational) Examination. The said qualification, after completion of the Bridge Course, has been declared to be the requisite qualification as per the Circulars issued by the respondents and the petitioner qualified the Bridge Course in the year 2000. He approached the respondents and filed representations but to no avail. The respondents have given appointment to less meritorious persons in the year 2000 but the petitioner has been denied appointment. Hence this writ petition. 3. I have heard learned counsel for the parties and perused the record. 4. The controversy involved in the instant case sets at rest in view of the judgment of the Hon'ble Supreme Court in Sunita Sharma & Ors. v. State of Rajasthan, JT 2001 (10) SC 178 , wherein the Hon'ble Apex Court 10 affirmed the decision of this Court to this effect that the qualification of Senior Secondary (Vocational) is equivalent to Senior Secondary (Academic) of the Board of Secondary Education. 5. A coordinate Bench of this Court, in Deep Chand v. State of Rajasthan & Ors., 2003 (1) WLC (Raj.) 187 , following the decision of the Hon'ble Supreme Court in Sunita Sharma's case (supra) held that the Senior Secondary (Vocational) with Bridge Course is the requisite qualification for appointment on the post of Teacher Grade III and the Court directed the Authorities to appoint the petitioner subject to other eligibility conditions; however, the petitioner was not held entitled to past salary but held entitled to seniority over appointees lower in merit than the petitioner. 6.
6. The instant writ petition stands squarely covered by the aforesaid decisions. Consequently, the writ petition is allowed and the respondents are directed to consider the case of the petitioner for appointment it he is otherwise eligible therefore. However, the petitioner shall not be entitled to past salary but he shall be assigned seniority over the appointees lower in merit than-the petitioner. There shall be no order as to costs. *******
